Terms of use

Effective 2026-09-27. These terms cover the NextBid Data API, the MCP endpoint and this website ("the Service"), operated by NextBid ("we"). Using a key means you accept them.

1. What the Service is

The Service gives you programmatic access to a normalized index of public government solicitations collected from public procurement portals, plus derived text and metadata. The issuing agency is the sole source of truth for every solicitation. We do not warrant that any record, deadline, contact, amendment or document is complete, current or correct. Verify with the issuing agency before you rely on anything, and always before you bid.

Do not use the Service to break any law, to harass or spam buyers, to misrepresent yourself to an agency, or to test or probe the Service's security without written permission. Rate limits, quotas and concurrency caps are part of the Service; automated retries must honour Retry-After.

5. Fees and billing

Paid plans are billed as described at signup or in writing from us. Usage is metered per call; your current usage is always visible at /v1/usage. Fees are non-refundable except where the law says otherwise. We may change prices with 30 days' notice by email to the address on your key.

6. Availability and changes

The Service is provided as is. We aim for high availability but do not guarantee it, and we may change, throttle or discontinue endpoints, fields or plans. Breaking changes to documented endpoints get at least 30 days' notice where practical.

7. Liability

To the fullest extent permitted by law, NextBid is not liable for any indirect, incidental, consequential or special damages, or for lost bids, lost profits or lost data, arising from the Service or its data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.

How we handle your e-mail address, keys and usage records is described in the privacy notice.

9. General

These terms are governed by the laws of the State of California, USA. If a part of them is unenforceable the rest stands. We may update these terms; the effective date at the top changes when we do, and continued use after a change is acceptance. Questions: keys@nextbid.us.
